Big announced

america granted

work permits for

indian spouses of h-1

b visa holders

Two US legislators have introduced a bill in the House of Representatives that would grant H-4 visa holders an automatic right to work in the United States. This would benefit the spouses of thousands of foreigners, including Indians, and address the labor shortage plaguing American businesses.

H-4 visas are issued to spouses and children of H-1B, H-2A, H-2B, and H-3 visa holders who accompany them to the United States. Many H-4 visa holders are highly skilled individuals who have previously pursued their own professions or supported their families.

The H-1B visa is a non-immigrant visa that allows US employers to hire foreign nationals for specialty occupations requiring theoretical or technical expertise. Technology companies rely on it to hire tens of thousands of employees from India and China each year.

H-2A visas are issued to temporary agricultural workers, H-2B visas to transient non-agricultural workers, and H-3 visas to nonimmigrant trainees or exchange visitors with special education needs.

The H-4 Work Authorisation Act, introduced by Congresswomen Carolyn Bourdeaux and Maria Elvira Salazar on Thursday, seeks to amend the current law and automatically grant spouses of H-1B visa holders the right to work after receiving their H-4 visa.

This would eliminate the need for visa holders to register for Form I-765, an Employment Authorization Document (EAD), according to their statement.

The two legislators stated that the proposed legislation aims to address the labor shortage impacting American businesses and assist immigrant families in thriving.

Even though they are already in the United States and their spouse is employed here, H-4 visa holders must currently register for work authorization and wait for it to be processed before they can work.

Due to backlogs at the United States Citizenship and Immigration Services (USCIS), approval of work authorization applications can take between six and eight months, with some applications taking over a year.

The bill, which has been backed by the National Immigration Forum and the non-profit advocacy group UnidosUs, aims to address America’s labor shortage by allowing visa holders to work swiftly and support their families

What are work permits?

1. Foreign spouses of US citizens can apply for work permits if they are sponsored by their spouse, have a valid visa, and meet certain requirements.

2. Work permits give foreign spouses the legal right to work in the United States. They also allow them to stay in the country longer than tourists or other non-immigrant visitors.

3. The process for obtaining a work permit is usually straightforward, but there may be some required paperwork and an interview with a US Citizenship and Immigration Services (USCIS) officer.

4. Once you have your work permit, you will need to show it when applying for a visa or when requesting entry into the US.

Who is eligible for a work

permit?

1. If you are an Indian national and your U.S. spouse is on an H-1B visa, you may be eligible for a work permit.

2. To be eligible, you must meet the following criteria:
-You must be in a committed relationship with your U.S. spouse
-Your U.S. spouse must have a valid H-1B visa
-Your marriage must not be a result of fraud or misrepresentation on your part
-You and your U.S. spouse must have met each other before entering into the relationship

3. You may only receive a work permit if it is determined that there is no qualified American citizen or permanent resident available to do the job that you are hired to do.

4. You will need to file an application for a work permit with the Department of State’s Bureau of Citizenship and Immigration Services (BCIS). The application process can take up to several months, so make sure to include all of the necessary documents.

What are the requirements

for a work permit?

Requirements for a work permit vary by country. In most cases, you will need to demonstrate that you are able to support yourself and your spouse. You may also need to provide proof of your relationship and health insurance. Some countries require a visa before you can apply for a work permit.

What happens after you

receive a work permit?

1. After you receive a work permit, you will need to go to the Department of Homeland Security (DHS) and file an application for adjustment of status news.

2. You will need to provide proof that you are in a valid relationship with your spouse and meet all other requirements of the Adjustment of Status process.

3. If you are approved for adjustment of status, your spouse will also be eligible for an immigrant visa and can come to the United States with you.

Conclusion

America has granted work permits for Indian spouses of H-1B visa holders, a move that is expected to increase the number of skilled professionals from India working in the United States. The work permits will be valid for up to six years and will allow Indian nationals to apply for jobs that would otherwise not be available to them due to their lack of experience or qualifications. The move comes as part of an effort by President Donald Trump’s administration to reduce dependence on foreign workers and help stem the tide of illegal immigration.
